These Terms of Service (the “Terms”) govern your access to and use of caterrasupply.com and any related content, features, tools, products and services (together, the “Services”) offered by Caterra Supply (“Caterra,” “we,” “us,” or “our”). By browsing the Services or placing an order, you agree to these Terms. If you do not agree, please do not use the Services.
Our Privacy Policy describes how we collect and handle your personal information and is incorporated into these Terms by reference.
1. Who we are

2. Eligibility
You must be at least the age of majority in your state or province of residence to purchase from us, or have the consent of a parent or legal guardian. By placing an order you represent that you meet this requirement and that the information you provide is accurate and complete.
3. Products, pricing and availability
All prices are listed in United States dollars (USD) and exclude taxes and any duties unless stated otherwise. We make every effort to display product colours, dimensions and specifications accurately, but we cannot guarantee that your display renders colours precisely, and product photography is illustrative.
Product availability is not guaranteed, and we may change or discontinue products at any time. We reserve the right to correct any error, inaccuracy or omission in pricing, product descriptions or availability, and to change or update information at any time without prior notice, including after you have submitted an order.
4. Orders
Your submission of an order is an offer to purchase. We may accept or decline any order, and we may limit or cancel quantities purchased per person, per household or per order. If we cancel an order after you have been charged, we will issue a refund to your original payment method.
We may refuse or cancel orders that appear to be placed by dealers or resellers, that contain apparent pricing errors, or that we suspect are fraudulent.
5. Shipping and delivery
We currently ship within the United States, and shipping is free on all United States orders. Delivery estimates are estimates only and are not guaranteed. Risk of loss and title pass to you on delivery to the carrier.
You are responsible for providing a complete and accurate shipping address. We are not responsible for delays or non-delivery caused by an incorrect address supplied at checkout.
6. Returns, refunds and warranty
Returns are accepted within 30 days of delivery, subject to the conditions described in our Refund Policy, which forms part of these Terms.
Our products carry a one-year limited warranty from the date of delivery against defects in materials and workmanship under normal household use. The warranty does not cover damage caused by misuse, accident, unauthorised modification or repair, commercial use, or normal cosmetic wear. Our sole obligation under this warranty is, at our option, to repair or replace the product or refund the purchase price.
7. Safe use of our products
Our products are electrically heated appliances intended for indoor household use in keeping already-cooked food warm. They are not cooking appliances. You agree to read and follow the operation manual supplied with the product, including all warnings regarding heat, electrical safety, supervision and cleaning.
Do not immerse the product or its controls in water, do not operate a product with a damaged cord or plug, and do not leave a heated product unattended around children or pets. Use the child lock where the product provides one. Failure to follow the supplied instructions may result in injury or property damage and may void the warranty.
8. Intellectual property
The Services and all content on them, including text, product photography, graphics, logos, and the Caterra name and marks, are owned by or licensed to us and are protected by intellectual property laws. You may not copy, reproduce, republish, distribute or create derivative works from any part of the Services without our prior written permission, except that you may view and print content for your own personal, non-commercial use.
9. Acceptable use
You agree not to use the Services for any unlawful purpose, to solicit others to perform unlawful acts, to infringe our or any third party’s intellectual property rights, to submit false or misleading information, to upload or transmit malicious code, to collect or track the personal information of others, to interfere with or circumvent the security features of the Services, or to scrape or harvest the Services by automated means without our permission.
10. Third-party links and services
The Services may contain links to third-party websites or services that we do not control. We are not responsible for their content, policies or practices, and their inclusion does not imply endorsement. Your dealings with third parties are solely between you and them.
11. Disclaimer of warranties
Except for the limited warranty expressly provided in Section 6, and to the fullest extent permitted by law, the Services and products are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Services will be uninterrupted, secure, or error-free.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you. Nothing in these Terms limits any rights you may have under applicable consumer protection law that cannot be waived.
12. Limitation of liability
To the fullest extent permitted by law, Caterra Supply and its officers, members, employees and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of or relating to your use of the Services or any product, whether based in contract, tort, strict liability or otherwise, even if we have been advised of the possibility of such damages.
To the fullest extent permitted by law, our total aggregate liability arising out of or relating to the Services or any product will not exceed the amount you paid for the product giving rise to the claim.
13. Indemnification
You agree to indemnify and hold harmless Caterra Supply and its officers, members and employees from any claim or demand, including reasonable legal fees, made by any third party arising out of your breach of these Terms or your violation of any law or the rights of a third party.
14. Governing law and disputes
These Terms are governed by the laws of the State of Utah, without regard to its conflict of law rules. You agree that the state and federal courts located in Salt Lake County, Utah will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Services, and you consent to the personal jurisdiction of those courts.
Before filing a claim, you agree to contact us at brian@simpleholdings.com and attempt in good faith to resolve the dispute informally. Most matters can be settled far more quickly this way.
15. Changes to these Terms
We may update these Terms from time to time. The current version is always posted on this page with its “Last updated” date. Changes take effect when posted, and your continued use of the Services after that constitutes acceptance. The Terms in effect at the time you placed an order govern that order.
16. General
If any provision of these Terms is found to be unlawful or unenforceable, that provision will be severed and the remaining provisions will remain in full force. Our failure to enforce any right or provision is not a waiver of that right or provision. These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and us regarding the Services.
